Participant’s Responsibility and Rules of Conduct

We expect and hope that you will use this registry as intended and in a responsible and respectful manner. Registration is conducted under the honor system and we are not required to verify any disability or review any documentation to verify any disability, nor does any law require you to register, any individual found to abuse this registry will be expelled from the registry. The registry is not intended to be a certification process and we do not judge the proficiency of our registrants in any way, and nor would that be necessary under the law. Of course, we recognize that under the law you are allowed to train your own animal and we can not be responsible or liable for the actions of dog owners or their dogs either online or offline. Please obey all laws as they apply to your situation.

These Terms & Conditions (“Terms”) govern your access to and use of ADARegistry.com and any related websites, services, products, registration services, digital profiles, documents, identification cards, certificates, and other offerings provided through the website (collectively, the “Services”).

By accessing the website, creating an account, purchasing a product or service, or otherwise using the Services, you agree to these Terms. If you do not agree with these Terms, you should not use the Services.

1. ABOUT OUR SERVICES

ADARegistry.com is an independent private organization that provides registration-related services, digital records, identification products, documents, and other products relating to service dogs, assistance animals, emotional support animals, therapy dogs, and companion animals.

ADARegistry.com is not a government agency and is not affiliated with, endorsed by, or operated by the U.S. Department of Justice, the Americans with Disabilities Act (ADA), any state or local government agency, or any other governmental organization.

Our products and services are optional and are not required by federal law to establish that an animal is a service animal.

Our Services are intended to provide customers with registration records, identification products, organizational tools, and related materials based on information provided by the customer.

2. NO CERTIFICATION OR LEGAL STATUS

Purchasing or receiving any product, registration number, identification card, certificate, letter, tag, vest, digital record, or other material from ADARegistry.com:

  • Does not certify a disability.
  • Does not certify that an animal is a service animal under federal, state, or local law.
  • Does not create or confer legal rights.
  • Does not guarantee access to housing, transportation, businesses, employment, public accommodations, or other locations.
  • Does not replace any documentation or determination required by law.
  • Does not guarantee that any third party will recognize, accept, or honor a product or document.

Customers are solely responsible for understanding and complying with applicable federal, state, county, and local laws.

3. CUSTOMER RESPONSIBILITY

You are responsible for ensuring that all information you provide to us is accurate and complete to the best of your knowledge.

You agree not to:

  • Provide knowingly false or fraudulent information.
  • Misrepresent your animal or its status.
  • Use our products to misrepresent yourself to a business, government agency, landlord, airline, employer, or other person or organization.
  • Use our Services for unlawful purposes.
  • Use our products to obtain benefits or accommodations to which you are not legally entitled.

We do not independently determine whether a customer has a disability or whether an animal legally qualifies as a service animal, emotional support animal, therapy animal, or other legally protected animal.

4. REGISTRATION

Registration is based on information submitted by the customer.

Registration with ADARegistry.com is not a government registration unless expressly identified as such for a specific government program.

A registration number, digital registration record, identification card, certificate, letter, or other product issued by us does not independently establish legal eligibility for an accommodation or other legal protection.

We reserve the right to refuse, suspend, or terminate a registration or account when we reasonably believe that the Services are being used fraudulently, unlawfully, abusively, or contrary to these Terms.

5. ACCOUNTS

Certain Services require you to create an account.

You are responsible for:

  • Providing accurate account information.
  • Maintaining the confidentiality of your password.
  • Keeping your account information current.
  • All activity occurring through your account.

You may not sell, transfer, or provide unauthorized access to your account.

6. PRODUCTS AND CUSTOM ITEMS

Some products offered through the website are customized using information supplied by the customer.

Customized products may include, without limitation:

  • Identification cards
  • Registration cards
  • Tags
  • Certificates
  • Letters
  • Vests
  • Printed documents
  • Personalized products

You are responsible for reviewing the information you provide before submitting an order.

If an item is produced incorrectly because of an error on our part, we may correct or replace the item.

If the customer provides incorrect information and the product is produced according to that information, replacement or correction may be subject to applicable replacement or shipping charges.

7. PRICING AND PAYMENT

Prices are displayed on the website at the time of purchase.

All amounts are charged in U.S. dollars unless otherwise stated.

You agree to pay all applicable charges, taxes, shipping fees, processing fees, subscription fees, and other charges associated with your purchase.

We reserve the right to change prices, products, and Services at any time. Price changes will not alter an order that has already been completed unless otherwise permitted by law.

8. SUBSCRIPTIONS AND RECURRING PAYMENTS

If you purchase a subscription or recurring membership, the applicable billing frequency and price will be presented to you before purchase.

Recurring charges will continue until the subscription is cancelled.

You may cancel a subscription using the cancellation functionality provided through your account or by contacting us through the designated customer-service method.

Cancellation stops future recurring charges but does not automatically reverse charges that have already been incurred.

Lifetime memberships, where offered, are paid one time and do not constitute recurring monthly or annual subscriptions.

9. REFUNDS AND CUSTOM PRODUCTS

Because many of our products and Services are customized or immediately activated, refunds may be limited.

Customized products, personalized identification cards, tags, certificates, printed materials, and Services that have already been provided or activated may be non-refundable except where otherwise required by applicable law or where we agree to provide a refund.

If you receive a product that is defective or contains an error caused by us, please contact customer service. We may, at our discretion, repair, replace, or otherwise correct the affected item.

This policy does not limit any rights that cannot legally be waived.

10. PRODUCT WARRANTY

Where a product-specific warranty is expressly provided at the time of purchase, that warranty will apply according to its stated terms.

A warranty against defects does not constitute a guarantee of legal acceptance or recognition of the product by any government agency, landlord, business, airline, transportation provider, employer, or other third party.

11. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a charge is incorrect, please contact us before initiating a payment dispute whenever reasonably possible so that we have an opportunity to investigate and resolve the matter.

Nothing in this section limits your rights under applicable payment-network rules or applicable law.

We reserve the right to suspend an account while investigating suspected fraudulent transactions, unauthorized purchases, abuse of the Services, or other payment-related misconduct.

12. DOCUMENTS AND CUSTOMER INFORMATION

Customers may have the ability to upload or store documents, photographs, records, and other information through their account.

You are responsible for maintaining copies of important documents.

Although we may take reasonable measures to maintain the Services, we do not guarantee permanent availability or preservation of any particular document or file.

We may remove content that violates these Terms or applicable law.

Our collection and handling of personal information is governed by our Privacy Policy.

13. NO LEGAL OR MEDICAL ADVICE

Information provided through the website is for general informational purposes only.

Nothing on the website constitutes legal, medical, psychological, psychiatric, veterinary, or other professional advice.

You should consult an appropriately licensed professional concerning your individual circumstances.

14. THIRD-PARTY ACCEPTANCE

ADARegistry.com cannot control how third parties interpret or respond to our products or Services.

We do not guarantee that a particular identification card, certificate, registration number, letter, tag, vest, digital record, or other product will be accepted by:

  • A landlord
  • An airline
  • A hotel
  • A business
  • A government agency
  • An employer
  • A transportation provider
  • A school
  • A housing provider
  • Any other third party

You are responsible for determining what documentation or requirements apply to your particular situation.

15. PROHIBITED USE

You agree not to use the website or Services to:

  • Commit fraud.
  • Misrepresent your identity.
  • Misrepresent an animal’s status.
  • Violate applicable law.
  • Infringe intellectual-property rights.
  • Attempt to gain unauthorized access to another account.
  • Interfere with website security or operation.
  • Scrape, crawl, data-mine, or harvest website information without authorization.
  • Upload malicious software or code.
  • Abuse, threaten, harass, or harm another person.
  • Submit knowingly false or misleading information.

16. USER-SUBMITTED CONTENT

If you submit information, photographs, documents, comments, reviews, or other content to us, you represent that you have the right to provide that material.

You retain ownership of your submitted content, subject to the rights necessary for us to provide the Services.

To the fullest extent permitted by law, our total liability arising from your use of the Services will not exceed the greater of:

(a) the amount you paid to us for the specific product or Service giving rise to the claim, or (b) $25.00.

This limitation does not apply where prohibited by applicable law.

21. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless ADARegistry.com and its owners, officers, employees, contractors, agents, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:

  • Your violation of applicable law.
  • Information or content you submit.
  • Your misuse of the Services.
  • Your representations concerning your animal or your eligibility for any legal accommodation.

22. SUSPENSION AND TERMINATION

We may suspend or terminate your account or access to the Services if we reasonably believe that you have violated these Terms, engaged in fraud or abuse, or used the Services unlawfully.

We may also discontinue or modify all or part of the Services at any time.

Termination does not eliminate obligations that by their nature should survive termination, including provisions concerning payment, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

23. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The updated Terms will become effective when posted on the website unless otherwise stated.

Your continued use of the Services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

24. GOVERNING LAW

These Terms shall be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable law requires otherwise.

25. DISPUTE RESOLUTION

Before initiating a formal legal proceeding concerning a dispute arising from these Terms or the Services, the parties should attempt in good faith to resolve the dispute by contacting customer service and providing reasonable written notice of the dispute.

Any arbitration provision, class-action waiver, venue requirement, or other dispute-resolution restriction should be included only after review for compliance with applicable federal and Arizona law.

26. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

27. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, applicable Refund Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and ADARegistry.com concerning your use of the Services.
